What is the best way to collect a judgement against someone?
Q. I have won a judgement against a person and she was served the judgement but she still refuses to pay. Everytime I find out where she lives and confronts her about my money she moves making it hard for me to find out where she is at. I know where she is living now and would like to do something before she moves again. I do not know where she is working but I do know that she works. I was told to file an Supplement Proceeding but I don't know which one to file. Would it be a Hearing before Court, a Citation Notice, a Form of Citation to discover Asset*Hearing before office. I went to the cook county of court building to get some help but they are not allowed to give you any kind of legal information. It has taken me over a year to find out… [cont.]

A. Don't worry about the statute of limitations. You have already won the lawsuit and the statute of limitations to collect the judgment will be a long time. The type of supplemental hearing is described in sec 2-1420 of the Illinois Code of Civil Procedure. It allows you to bring the person back to Court and ask them what they have and where they have it. Then you get a writ of attachment or a writ of garnishment to collect property from the places (like banks and employers) that you found have property belonging to the person.

A. Marcsnothere was on the right track, until he suggested you send them $20 a month. Not only can they still harass you for the debt, that would likely reset the statute of limitations on the debt and could be taken as an admission of the debt. If this was a collection agency that did this, you have them on an FDCPA violation for misrepresenting the legal status of a debt provided a judgement doesn'tt exist. You can bring suit on them for this, and for something of this caliber you'd almost be guaranteed a victory.

A. You will first be offered a chance to pay be a certain date. Interest will continue to accrue on the total amount of the judgment, including costs and fees. Then, the enforcement mechanisms vary by state and country. Every state has different laws on garnishment, seizure of assets, etc.

A. Ya know something? Driving is not a game; the fines and probation and stuff are not just negative hits that will cure over time - they are the other drivers (in the form of the system) telling you that you are driving unsafely. Too much of that and you'll lose your license. What will happen will happen and not only will you deserve it you have only yourself to blame. Slow down or face the consequences.

A. If you have assets, why wouldn't you just pay your bills? I don't understand this reasoning. Someone was kind enough to lend you the money when you needed it, yet you will work and research to stiff them on it rather than pay them back with a thank you?

How long does a judgement stay on your credit report in Virginia?

A. According to the FCRA rules, judgments remain on a persons credit report for 7 years from the date of payment of the judgment. It is not like the regular time period for past due debts. Now if you paid it in 2001, then you should send proof to the CRA's and ask it to be removed (they do sometimes overlook things). Hope this answers your question EDIT: I did make a boo boo, I was looking at the rules regarding the three kinds of public records that may appear on your credit report: tax liens, financial judgments, bankruptcies. Paid tax liens will remain for seven years from the paid date, even though it may mean the item remains for longer than 15 years total. What happens when an elderly person gets a judgement? The only income they have is social security?
Q. If there only income is social security. How does the person get their judgement from an elderly person on a non secured credit card? They also have no money in the bank so that is not an option.

A. Social Security can only be garnished for child support, IRS, student loans or other Fed government debts. If the only money put into a bank account is Social Security, the bank account can not be garnished. The creditor could lien any real property. But not much else. Typically an elderly person on SS is pretty judgment proof. The credit really wasted time and money going to court for this judgment.

A. If the loan or the home purchase were made after you were married yes, this is a community property state, and debts count as property. If you owned the home prior to getting married or she took out the loan they can not put a lien on the house. They attach her wages and tax return instead. Her destroyed credit will effect yours though, for better or worse.

A. It means that you have been sued and you lost. As a result the court ordered you to pay the money. Now the creditor can do a bunch of things to enforce the judgment including garnish your wages, attach property or seize accounts.

Can a county court judgement stop you moving country?
Q. I have a friend who is planning to move to Australia next year but he has a debt he hasn't paid off and may be taken to court over it and would then get a county court judgement. He is already a citizen of Australia but living here in the UK. Would the CCJ stop him from moving to Australia? A. If he is a citizen of Australia they cannot stop him from going home. A county court judgement is a civil judgement and has no effect outside UK. I feel he should be honest with the debtor and make arrangements to pay off the debt bit by bit. Take no notice of the amateur advice you have been given ( most of it is spelt wrong anyway.)

What is the date used for calculating interset in a judgement payment in Illinois?

A. There should be a "Due" date per the judgement, that is the date (So 15 of every month due date would mean that interest is calculated thereafter if not received).

How do we report an unpaid civil judgement to the credit bureau?

The defendant never paid this amount and we would like for this to show up on his credit report. A. It isn't automatic and there is no minimum time. The person winning the judgment has to file a "Writ" of garnishment. The writ is served on the person who pays your wages. After that it is just the amount of time it takes your employer to process the paperwork and have payroll start taking out the money.
